KuliMuli: SensoryPlay Terms of Use

These Terms of Use ("Terms") govern your access to and use of the KuliMuli: SensoryPlay mobile application, website and related services (collectively, the "Service").
The Service is operated by Gražina Mikalauskienė, operating as an individual under an individual activity certificate in Lithuania ("KuliMuli", "we", "us" or "our").
By creating an account, accessing or using KuliMuli: SensoryPlay, you agree to these Terms.
If you do not agree with these Terms, please do not use the Service.

1. About KuliMuli: SensoryPlay
KuliMuli: SensoryPlay is an application designed to help parents and caregivers discover, organise and track play and developmental activities for children.
The Service may include features such as:
Activity ideas
Sensory play ideas
Development-related activity suggestions
Child profiles
Favourite activities
Completed activity tracking
Developmental progress tracking
Sensory preferences
Personal notes
Custom activities
Activity planning
Premium features and content
Features may be added, changed or removed over time.
2. Who May Use the Service
KuliMuli: SensoryPlay is intended for adults aged 18 or older.
Children are not intended to create accounts, manage accounts, purchase subscriptions or use the Service independently.
Activities available through the Service are intended to be selected, prepared and supervised by a responsible adult.
By creating an account, you confirm that you are at least 18 years old and legally capable of entering into these Terms.
3. Parent and Caregiver Responsibility
KuliMuli provides activity ideas and organisational tools for parents and caregivers.
You are responsible for deciding whether an activity is appropriate for a particular child.
Children develop at different rates and may have different abilities, interests, sensitivities and safety needs.
Age recommendations, developmental categories or other classifications provided in the App are general guidance only and do not guarantee that an activity is appropriate for every child of a particular age.
You are responsible for:
Supervising children during activities
Assessing whether materials are safe and age-appropriate
Considering choking, allergy, ingestion and other safety risks
Checking toys and materials before use
Following manufacturer safety instructions
Adapting activities to the child's individual abilities
Stopping an activity if it appears unsafe or unsuitable
Never leave a child unattended during an activity where adult supervision is appropriate.
4. Not Medical or Professional Advice
KuliMuli: SensoryPlay is an educational and play-focused application.
The Service does not provide:
Medical advice
Medical diagnoses
Occupational therapy
Speech therapy
Psychological assessment
Developmental diagnosis
Physiotherapy
Nutrition advice
Other healthcare or professional services
Information about developmental skills, sensory play or child development is provided for general educational purposes only.
The App is not intended to diagnose developmental delays, sensory processing disorders, medical conditions or other health concerns.
If you have concerns about a child's development, health, behaviour or wellbeing, you should consult an appropriately qualified healthcare or child-development professional.
5. User Accounts
Some features require a KuliMuli account.
Users may create or access an account using:
Email and password
Sign in with Google
Sign in with Apple
You are responsible for maintaining the confidentiality of your login credentials and for activity performed through your account.
You agree to provide accurate information and to keep your account information reasonably up to date.
You must not:
Share your account credentials with unauthorised persons
Access another person's account without permission
Attempt to bypass authentication or security measures
Create an account using false or misleading identity information for fraudulent purposes

6. Child Profiles
Adult users may create profiles containing information relating to a child.
A child profile may include information such as:
Name or nickname
Age
Gender
Optional profile photo
Favourite activities
Completed activities
Sensory preferences
Developmental progress
Notes entered by the parent or caregiver
By creating or managing a child profile, you confirm that you are authorised to provide and manage that information.
Please provide only information that is reasonably necessary for using KuliMuli.
KuliMuli is not intended to store medical records, diagnoses or detailed sensitive health information.

7. User-Generated Content
KuliMuli may allow you to create content such as:
Notes
Custom activities
Activity descriptions
Child profile information
Uploaded child profile photographs
You retain ownership of content that you create or upload.
You grant KuliMuli a limited right to store, process, display and technically reproduce that content only as necessary to operate and provide the Service to you.
We do not claim ownership of your private notes, photographs or custom activities.
You are responsible for content you submit to the Service.
You must not upload or create content that:
Violates applicable law
Infringes another person's intellectual property or privacy rights
Is fraudulent or deliberately misleading
Contains malicious software or code
Is abusive, threatening or unlawful
Contains content that you do not have the right to upload
8. Activity Content and Intellectual Property
Unless otherwise stated, the KuliMuli brand, application design, activity database, written activity descriptions, illustrations, graphics, logos, visual elements and other content provided by KuliMuli are owned by or licensed to KuliMuli.
This content is protected by applicable intellectual property laws.
Your use of the Service does not transfer ownership of KuliMuli intellectual property to you.
You may use activity content for personal and non-commercial use.
Unless we provide written permission, you may not:
Reproduce substantial portions of the activity database
Copy and republish KuliMuli activity descriptions as your own
Sell or commercially distribute KuliMuli content
Scrape or systematically extract content from the Service
Create a competing database using substantial portions of KuliMuli content
Remove copyright, trademark or ownership notices
Use KuliMuli branding in a way that suggests an unauthorised partnership or endorsement
You may naturally carry out the activities with your own children, family or within ordinary personal use.
9. AI-Assisted Images
Some activity reference images displayed in KuliMuli: SensoryPlay may have been created with the assistance of generative artificial intelligence tools, including Google Gemini.
Such images are generated during KuliMuli's content creation process before being displayed to users.
User information and child-profile information are not sent to Gemini for this purpose.
AI-generated illustrations are intended as visual references. Actual materials, colours, proportions or results may differ from the illustration.
10. Free and Premium Features
KuliMuli may offer both free and paid features.
Certain activities, functionality or content may only be available as part of a paid Premium subscription.
The specific features included in free and Premium versions may change over time.
Where reasonably possible, significant changes affecting an active paid subscription will be communicated appropriately.
11. Premium Subscriptions
Premium subscriptions may be purchased through:
Apple App Store
Google Play
Subscription management is supported through RevenueCat.
Prices, subscription periods, introductory offers and renewal terms are displayed before purchase through the relevant App Store or Google Play interface.
Subscriptions may automatically renew unless cancelled according to the rules of Apple or Google applicable to the purchase.
KuliMuli does not receive or store your full credit or debit card details.
12. Subscription Renewal and Cancellation
Subscriptions purchased through the Apple App Store or Google Play must generally be managed through the same platform used to make the purchase.
Deleting the KuliMuli App or deleting your KuliMuli account does not automatically cancel an active subscription.
You are responsible for cancelling an active subscription through your Apple or Google account if you no longer wish it to renew.
After cancellation, Premium access may remain available until the end of the already-paid subscription period.
13. Payments and Refunds
Payments made through the Apple App Store or Google Play are processed by the relevant platform.
Refund requests are generally subject to the refund rules and procedures of Apple or Google, depending on where the subscription was purchased.
KuliMuli does not directly process payment-card transactions made through the Apple App Store or Google Play.
Nothing in these Terms limits any mandatory refund, cancellation or consumer rights that apply under applicable law.
14. Changes to Subscription Prices
Subscription prices may change in the future.
Any price changes will be implemented in accordance with the requirements of the relevant App Store, Google Play and applicable consumer law.
Where required, users will be notified before a new subscription price applies.
15. Account Deletion
You may delete your KuliMuli account from within the App using the Delete Account functionality.
Deleting an account permanently removes the user's KuliMuli account and associated information from our active systems, including information such as:
Email address
Child profiles
Uploaded child profile photographs
Notes
Favourites
Activity history
Completed activities
Developmental progress
Sensory preferences
Custom activities
Account deletion cannot normally be reversed.
Limited residual copies may remain temporarily in backups or where retention is required by law.
Deleting your KuliMuli account does not necessarily cancel an active Apple App Store or Google Play subscription.

16. Acceptable Use
You agree to use the Service only for lawful purposes.
You must not:
Attempt to gain unauthorised access to the Service or other users' accounts
Interfere with or disrupt the operation of the Service
Attempt to circumvent subscription or Premium access restrictions
Reverse engineer the Service except where expressly permitted by law
Use automated tools to scrape or extract substantial amounts of content
Introduce viruses, malware or malicious code
Use the Service for fraudulent purposes
Abuse, overload or intentionally damage our infrastructure
Use the Service in a way that violates another person's rights
Resell access to the Service without permission
We may restrict or terminate accounts involved in serious or repeated misuse.
17. Third-Party Services
KuliMuli relies on third-party services to provide certain technical functionality.
These may include:
Supabase
Apple
Google
RevenueCat
Airtable
Your interaction with certain third-party services may also be subject to their own terms and policies.
KuliMuli is not responsible for third-party services that operate independently from KuliMuli, except to the extent required by applicable law.
18. Third-Party Links and Products
Activities may occasionally reference materials, toys, products, websites or resources provided by third parties.
Unless specifically stated otherwise, such references do not mean that the third party sponsors, operates or endorses KuliMuli.
Third-party products and websites are governed by their own terms, privacy policies and safety information.
You are responsible for assessing whether any third-party product or material is appropriate for your intended use.
19. Availability of the Service
We aim to keep KuliMuli available and functioning reliably, but we cannot guarantee uninterrupted or error-free availability.
The Service may occasionally be unavailable because of:
Maintenance
Updates
Technical problems
Third-party infrastructure problems
Security issues
Events outside our reasonable control
We may update, modify, suspend or discontinue parts of the Service where reasonably necessary.
20. Changes to Activities and Features
KuliMuli is an evolving product.
We may:
Add new activities
Remove or update activities
Change categories
Change free and Premium feature availability
Improve or replace features
Change the visual design or functionality of the Service
We do not guarantee that every specific activity or feature will remain available indefinitely.
21. Disclaimer of Warranties
To the extent permitted by applicable law, the Service is provided on an "as available" basis.
While we aim to provide useful, accurate and age-appropriate content, we do not guarantee that:
Every activity will be suitable for every child
Every child will achieve a particular developmental result
Activities will produce specific educational or developmental outcomes
The Service will always be error-free or uninterrupted
Every piece of information will be complete or applicable to every individual situation
Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.
22. Safety Disclaimer
Activity descriptions and images cannot identify every possible risk associated with an activity.
Parents and caregivers remain responsible for evaluating materials and supervising children.
Particular care should be taken with materials that may present risks including:
Small objects
Choking hazards
Water
Food ingredients
Allergens
Scissors or cutting tools
Paints, glues or craft materials
Sensory materials
Objects that may be swallowed
Activities involving climbing, jumping or physical movement
Always adapt activities to the child's age, abilities and circumstances.
23. Limitation of Liability
To the maximum extent permitted by applicable law, KuliMuli will not be responsible for indirect, incidental or consequential loss arising solely from the use or inability to use the Service.
KuliMuli is not responsible for injury or damage resulting from:
Failure to adequately supervise a child
Use of inappropriate materials
Ignoring product safety instructions
Using an activity in a way materially different from its intended purpose
Activities selected despite known individual safety concerns
However, nothing in these Terms excludes or limits liability where such limitation is prohibited by law.
Nothing in these Terms affects mandatory consumer rights available to you under Lithuanian, European Union or other applicable consumer-protection law.
24. Suspension or Termination
You may stop using KuliMuli at any time.
We may suspend or terminate access to an account if reasonably necessary because of:
Serious violation of these Terms
Fraudulent activity
Security risks
Illegal use of the Service
Attempts to damage or misuse the Service
Where appropriate and reasonably possible, we may provide notice before termination.
25. Privacy
Your use of KuliMuli is also governed by the KuliMuli: SensoryPlay Privacy Policy.
The Privacy Policy explains how personal information, including child-profile information, is collected, used, stored and deleted.
These Terms and the Privacy Policy should be read together.
26. Changes to These Terms
We may update these Terms from time to time, particularly when:
New features are introduced
Subscription functionality changes
Legal requirements change
Service providers or business practices change
The date at the top of these Terms indicates when they were last updated.
For material changes, we may provide additional notice through the App, website or other appropriate means.
Where required by law, we will request renewed agreement before materially different terms take effect.
27. Governing Law
These Terms are governed by the laws of the Republic of Lithuania, without prejudice to mandatory consumer protections that may apply in the country where you live.
If you are a consumer residing in the European Union or another jurisdiction that provides mandatory local consumer rights, these Terms do not remove those rights.
Before pursuing formal proceedings, we encourage users to contact us at info@kulimuli.net so that we can try to resolve the issue.
28. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
29. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms clearly presented for specific features or subscriptions, form the agreement governing your use of KuliMuli: SensoryPlay.
